Terms and Conditions

First Class Sailing Ltd Terms and Conditions

1) The yacht is fully insured against accidents and third party liability but responsibility is not accepted for personal accidents, damage or loss attributable to your negligence, recklessness or gross misconduct. First Class Sailing Ltd reserves the right to hold any student liable for any/all damage or loss resulting from negligence or misconduct.

2) Personal Insurance. You are strongly advised to arrange your own insurance at the time of booking to cover against personal accident, cancellation, medical and repatriation etc. One such company, whom we have a relationship with, that offers this type of policy is Top Sail Insurance (www.topsailinsurance.com/firstclasssailing) but you should make your own enquiries.

3) The deposit is non-returnable once received. The balance of monies due is payable 70 days before the course/charter commences. If the booking is made within 70 days of departure the full sum is due at time of booking unless otherwise specified at the time of booking.  

4) If you wish to cancel or amend your booking: Booked dates are final. It is not possible to change dates once you have booked. You may cancel your course at any time. Written notification [email] must be received by our sales team. Cancellation will be effective on the day notification is received. Cancellation charges are as follows. Period before departure: 71+ days: deposit only; 43-70 days: 50% of total; 29-42 days: 75% of total; 28 days or less: 100% of total. If the reasons for your cancellation are covered under the terms of your insurance policy, you may be able to reclaim these charges. A cancellation invoice will be issued on request. Where a deposit amount has not been specified at the time of booking it shall be 25% for refund purposes. 

5) If we cancel your course: Arrangements for courses are made many months in advance. We reserve the right in any circumstances to cancel a course or your booking. If we cancel your booking our liability is limited to monies already paid, which will be refunded. If we cancel a course once it has started you will be eligible for a pro-rata refund for the portion of the course/booking that is not fulfilled. We may offer as an alternative a replacement course, which you may choose to accept in place of a refund. Such an offer once accepted, constitutes a new booking subject to all the aforesaid terms and conditions. Occasionally we may need to make changes which may include, but are not limited to: a] a change of destination, embarkation and/or disembarkation b] change of departure point, c] change of vessel, d] change of instructor. Such matters do not constitute conditions of the contract and changes to them by us do not constitute a cancellation. In the case of all bookings if for any reason the yacht cannot reach its intended destination port . First Class Sailing Ltd accept no liability for any travel or other expenses incurred as a result. 

6) In the case of Racing events organised by third parties First Class Sailing Ltd reserves the right to alter/cancel the training day and/or entry into any of the race at any time for any reason outside of our control, including but not limited to bad weather. Withdrawal from a race once started is at the skipper’s discretion at all times. Such withdrawal will not give rise to any refund of fees. However, First Class Sailing Ltd do undertake to make every effort to ensure the boat and the crew have the opportunity to finish the Race. It may be that the Race Organising Committee change dates, cancels or abandons races. For the avoidance of doubt . First Class Sailing Ltd will accept no responsibility in this event and no refund or credit note or transfer to another . First Class Sailing Ltd event will be due.

7)Should you at any time feel that a course has not met your expectations or you have a concern, it is vital that you bring the issue to the attention of your instructor. The issue may be resolved by him/her. If more appropriate please notify First Class Sailing’s office at the earliest possible opportunity. Telephone 0203 006 3717 or 02380 011 077. We may not be able to offer alternative arrangements for comments received after the course is completed, if the issue could have been solved or ameliorated at the time.

8) It must be recognised that boating is by its nature an unpredictable sport and therefore inherently involves an element of risk. By taking part, you agree and acknowledge that:

i) You are aware of the inherent element of risk involved in the sport and you accept responsibility for exposing yourself to such inherent risk whilst taking part in your course/trip/event;

ii) You will comply at all times with the instructions of the Instructor/Skipper particularly with regard to handling of boats, wearing of life jackets and the wearing of suitable clothing for the conditions;

iii) You accept responsibility for any injury, damage or loss to the extent caused by your own negligence, recklessness or misconduct;

iv) You will not participate in the course/trip/event if [under the influence of]/OR [your ability to skipper a vessel is impaired by] alcohol, drugs or if otherwise unfit to participate

v) You are aware of the inherent risk of exposure to any contagious disease that other participants in the course/trip/event may be carrying and you accept responsibility for exposing yourself to such inherent risk whilst taking part in the course/trip/event;

vi) You have satisfied yourself as to your [suitability]/[eligibility] for the course you are attending. This includes the meeting of any pre-stated pre-requisite qualifications/experience and with regard to adequate fitness and mobility levels; 

vii) You will inform the organiser if there have been any changes to information provided at the time of the course/trip/event.

9) For the Sea Survival Course - You agree to partake in a practical liferaft swimming pool session as part of the course. This involves some physical exertion in the deep end of the swimming pool and jumping from a height while wearing a life jacket and clothing. You are fit and willing to participate in the course/s indicated. You can swim for a distance of at least 25m.

10) You do not object to appearing in photographs, video footage, radio or newspaper interviews, social networking/media that may be used by First Class Sailing Ltd or the media unless First Class Sailing Ltd are notified otherwise.

11) You will not be able to sail with us if you are positive for Covid and in such a situation you will not be eligible for a refund. You are advised to take suitable precautions to ensure you do not catch Covid in the run up to sailing with us.


  • You have read, understood and accept the terms and conditions and shall complete the health declaration 
  • You declare that, as required by this booking you will disclose any medical conditions you have or you declare that to the best of my knowledge you are not suffering from epilepsy, disability, giddy spells, asthma, diabetes, angina or heart condition and you are fit to take part. If these details change prior to arrival you undertake to inform First Class Sailing and/or the skipper at once. You agree to First Class Sailing using this information should the relevant need arise. 
  • You have read, understood and accept the privacy policy relating to the use and storage of your data and health information 


You are strongly recommended to arrange your own suitable insurance cover for any loss, cancellation, injury, personal belongings and personal liability.



These Terms & Conditions are for First Class Sailing LTD Led bookings associated with a Challenger 72 yachts

1. Conditions of Booking

The Tall Ships Limited Conditions of Booking (the “TS Conditions”) appended to this Booking Form are hereby incorporated into and form an integral part of this Booking Form, subject to the following amendments:

i) In clause 1.1 of the TS Conditions, the reference to Tall Ships Limited is to be taken as being a reference to First Class Sailing Ltd;

ii) In clause 2.1.15 of the TS Conditions, the reference to Tall Ships Limited is to be taken as being a reference to First Class Sailing Ltd;

iii) In clauses 2.1.20 and 9.12 of the TS Conditions, the references to “our website” is to be taken as being a reference to Tall Ships Limited’s website;

iv) Clause 3.1 of the TS Conditions is replaced with the following: “We are First Class Sailing Ltd, a company incorporated and registered in England and Wales with company number 05644163 whose registered office is at Unit 3 and 4, Building 15, Shamrock, Quay, William Street, Southampton, Hampshire, SO14 5QL”;

v) Clause 3.2 of the TS Conditions is replaced with the following: “You can contact us by telephoning 0203 006 3717 or 023 8001 1077 or by writing to us at [email protected] or at our registered office”;

vi) Clause 5.1 of the TS Conditions is replaced with the following: “You may book with us directly by telephone on 0203 006 3717 or 023 8001 1077 or via www.firstclasssailing.com”;

vii) In clause 9.17 of the TS Conditions, the reference to “the Crew Member Information Form and Agreement” is to be taken as being a reference to First Class Sailing Ltd’s crew information form and the words “(the template for which is attached as the Appendix to these Conditions of Booking)” shall be taken as deleted;

viii)In clauses 12.1 and 12.2 of the TS Conditions, the reference to the “Website” shall be taken as being a reference to First Class Sailing Ltd’s website: www.firstclasssailing.com;

ix) Clause 12.3 of the TS Conditions is replaced with the following:   

The Voyage Fee and Travel Insurance Premium (where applicable) are to be paid as follows: 

  • The deposit is non-returnable once received.  
  • For trips up to the value of £1000: The balance of monies due is payable 70 days before the booking commences. If the booking is made within 70 days of departure the full sum is due at time of booking unless otherwise specified at the time of booking. A 25% deposit may be taken at the time of booking 
  • For trips priced over £1000 and up to a value of £3000: Payment terms are as follows. Period before departure: 25% deposit at time of booking; 50% 182+ days prior to departure: the balance (25%) 84+ days prior to departure.   
  • For trips priced over £3000: Payment terms are as follows. Period before departure: 25% deposit at time of booking; 40% 252+ days prior to departure: the balance (35%) 161+ days prior to departure.   

x) In clause 13.5 of the TS Conditions, our liability in case of cancellation of an individual booking is to be limited as follows. Booked dates are final. It is not possible to change dates once you have booked. You may cancel your booking at any time. Written notification [email] must be received by our sales team. Cancellation will be effective on the day notification is received.  

Cancellation charges are as follows:  

  • For trips priced up to value of £1000: Cancellation charges are as follows. Period before departure: 71+ days: deposit only; 43-70 days: 50% of total; 29-42 days: 75% of total; 28 days or less: 100% of total.  
  • For trips priced over £1000 and up to a value of £3000: Cancellation charges are as follows. Period before departure: 148+ days: deposit only; 71-147 days: 50% of total; 56-70 days: 75% of total; 56 days or less: 100% of total.  
  • For trips priced over £3000: Cancellation charges are as follows. Period before departure: 246+ days: deposit only; 155-245 days: 50% of total; 85-154 days: 75% of total; 57-84 days: 90%; 56 days or less: 100% of total.  
  • If the reasons for your cancellation are covered under the terms of your insurance policy, you may be able to reclaim these charges. A cancellation invoice will be issued on request.  
  • Where a deposit amount has not been specified at the time of booking it shall be 25% for refund purposes. 

xi) In clause 13.6 of the TS Conditions, our liability in case of cancellation of a group booking is to be limited as follows: Booked dates are final. It is not possible to change dates once you have booked. You may cancel your booking at any time. Written notification [email] must be received by our sales team. Cancellation will be effective on the day notification is received. Cancellation charges are as follows. Period before departure: 307+ days: deposit only; 157-306 days: 50% of total; 36-156 days: 90% of total; 35 days or less: 100% of total;

xii) In clause 16 of the TS Conditions, the reference to the “Website” shall be taken as being a reference to First Class Sailing Ltd’s website: www.firstclasssailing.com.

2.  It must be recognised that boating is by its nature an unpredictable sport and therefore inherently involves an element of risk. By taking part in the voyage, you agree and acknowledge that:

i) You are aware of the inherent element of risk involved in the sport and you accept responsibility for exposing yourself to such inherent risk whilst taking part in voyage;

ii) You will comply at all times with the instructions of the Skipper particularly with regard to handling of the boat, wearing of life jackets/ aids and the wearing of suitable clothing for the conditions;

iii) You accept responsibility for any injury, damage or loss to the extent caused by your own negligence, recklessness or misconduct;

iv) You will not participate in the voyage if [under the influence of]/OR [your ability to perform as crew is impaired by] alcohol, drugs or if otherwise unfit to participate

v) You are aware of the inherent risk of exposure to any contagious disease that other participants in the voyage may be carrying and you accept responsibility for exposing yourself to such inherent risk whilst taking part in the voyage;

vi)  You have satisfied yourself as to your [suitability]/[eligibility] for the voyage.  This includes the meeting of any pre-stated pre-requisite qualifications/experience and with regard to adequate fitness and mobility levels

vii) You will inform the organiser if there have been any changes to information provided at the time of the voyage;


3. You do not object to appearing in photographs, video footage, radio or newspaper interviews, social networking/media that may be used by First Class Sailing Ltd or the media unless First Class Sailing are notified otherwise in writing.


4. You will not be able to sail with us if you are positive for Covid and in such a situation you will not be eligible for a refund. You are advised to take suitable precautions to ensure you do not catch Covid in the run up to sailing with us.


Tall Ships come with their own terms and conditions.

Please review the tall ships conditions before declaring that you have read the terms and conditions and completed the health declaration.
